of the income tax amendment at

Perhaps the most interesting are images of the official correspondence
between Sec. of State Philander Knox and the Chief Clerk of the Office of
the Solicitor. They reveal much, and conceal much.

Then Secretary of State Philander Knox assumed the duty of declaring whether
a proposed constitutional amendment had been ratified. There was no
statutory or constitutional basis for that, only custom. However, as the
correspondence indicates, he or his office did not review the evidence of
ratification by the states directly. That was apparently done in the Office
of the Solicitor, a department of the Office of the U.S. Attorney-General.
Know relied on a report from the Chief Clerk of the Office of the Solicitor.
That report reveals just enough of the problems with the ratification
process to provide cover for the Chief Clerk if the entire process came to
light, while discounting the problems as unimportant. We don't know whether
Knox was personally aware of the problems with the evidence beyond what the
Chief Clerk revealed, but by keeping the matter at arms length in that way,
it also provided a cover for Knox if exposure occurred. This is a classic
model of government fraud, where responsibility and information is divided
so that if exposure occurs the fraud can be explained as an oversight or
administrative error.
