Where is the Will of the People? Part Two
Rev. Donna Carol Raifsnider, December 7, 2000 Pearl Harbor Day

I have followed this "war on the constitution" as closely as I can while attending to my family and ministry duties. I have a new point to ponder today. Why is the Democratic Party and Vice President Al Gore ignoring the Constitution which they swore or affirmed to preserve and protect? The aggressiveness at which the election is being challenged would cause one to think that Gov. George W. Bush was a foreign power attempting to seize control of our government!! I can find no other cause to overthrow the Will of the People as stated in Article II. Section 1. of the Constitution for the United States of America. (Text provided below)

In my previous comments about our election I pondered where the Will of the People really is, whether it be in the Democrats, Republicans, or Constitution. Law says the Will of the People is in the Constitution. All elected and appointed officials are required to swear or affirm that they will preserve and protect the Constitution for the United States of America.

What I have been hearing on the news lately is our Vice President using language referring to the "Will of the People" in such a way to curry favor with those that would support his ideas and protest publicly so media can show the will of his people, which confuses the issue of which will he is really referring to; the "will of the Democrats" or the "Will of the American People", as stated in the People's law, Article II of the Constitution.

Today, December 7, 2000, Pearl Harbor Day, I listened to some of the proceedings before the Florida Supreme Court. In the commentary that followed it was noted that the protestors were not there as they have been before. Only one was noticed and it was reported that he carried a sign with a different message..we need to come together America.

We can come together and end this thing now by coming together under and with our law which we the People declared in the Constitution for the United States of America. In Part One I wondered "Where is the Will of the People?" Today I declare it is written in law, not in Political Partys.

This American Citizen would also like to point out that I am aware of instances where judges have withheld facts from jurors because the judge believed that those particular facts would confuse the jury. Also, this push to re-count votes began with an argument from attorneys that the voters were confused by the Butterfly Ballots.

How about it America, are you so easily confused that judges should protect you from the facts and Political Partys need to divine your will and correct your ballot for you? I THINK NOT!

I pray that it is the rule of law and not the party wish that ends this war on our great constitution for the United States of America.

    Article. II. United States Constitution
    Section 1.
The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected, as follows:
Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.
The Electors shall meet in their respective States, and vote by Ballot for two Persons, of whom one at least shall not be an Inhabitant of the same State with themselves. And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List they shall sign and certify, and transmit sealed to the Seat of the Government of the United States, directed to the President of the Senate. The President of the Senate shall, in the Presence of the Senate and House of Representatives, open all the Certificates, and the Votes shall then be counted. The Person having the greatest Number of Votes shall be the President, if such Number be a Majority of the whole Number of Electors appointed; and if there be more than one who have such Majority, and have an equal Number of Votes, then the House of Representatives shall immediately chuse by Ballot one of them for President; and if no Person have a Majority, then from the five highest on the List the said House shall in like Manner chuse the President. But in chusing the President, the Votes shall be taken by States, the Representatives from each State having one Vote; a quorum for this Purpose shall consist of a Member or Members from two thirds of the States, and a Majority of all the States shall be necessary to a Choice. In every Case, after the Choice of the President, the Person having the greatest Number of Votes of the Electors shall be the Vice President. But if there should remain two or more who have equal Votes, the Senate shall chuse from them by Ballot the Vice President.
The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.
