I was until a week or so ago the "J.A.I.L.er in Chief" for the state of Idaho which is to say I was the leader for the Judicial Accountability Initiative Law (J.A.I.L.) movement here in Idaho.

After about 2 years of trying to get some support from the state legislators to have a constitutional amendment to our state constitution passed (which is the #1 goal of J.A.I.L. according to its founder, Ron Branson) we here realized that it was impossible.

Then, last year we attempted to have the J.A.I.L. initiative placed on the ballot for the elections of this past November, as the laws here provide for a voter's initiative. We needed a little over 43K qualified signatures in order to accomplish that which was an impossible feat considering we didn't begin until the end of February and the deadline was in April. Several of us did a statewide petition drive and toured the state with our judicial reform advocacy, nevertheless.(We dreamed the impossible dream) We even set up at the state capital. We garnered media attention across the state, appearing on nightly news and radio shows. The mainstream press here ate it up and we had the full support of an Idaho based opposition newspaper called the "Idaho Observer" (http://www.proliberty.com/observer)We made prearranged stops along our way through this state. The gatherings were good and the people were receptive about this country's need for something like J.A.I.L. (which by the way is a short version of the official national organizational name; "JAIL4judges")We even had a judicial candidate speaking out and supporting our initiative. (By the way he got himself elected)Even the chief justice of our state supreme court was forced to take a stand for or against the initiative while politiking to retain her seat in the Nov elections. In other words we gave our all. But it wasn't good enough and we failed to obtain the necessary number of qualified signatures to get it on the ballot.

We were gearing up for another go at it even before the elections were over. Only this time we would have a full 2 yrs to get the signatures. It would of been a piece of cake! Then we would only need about $250,000 - $1,000,000+ to get our campaign message out to the electorate. We were mentally and organizationally ready for that too.

Why am I telling you all this ? Im'm getting there!

Before launching our new signature gathering campaign we in the J.A.I.L. organization here were exited to hear that the founder of JAIL4judges was considering giving our state, alone,the support of the national organization. (probably because we are such a gung ho gang for judicial reform here but mostly because we were one of the few states with a constitutional initiative process - ooops we are not)

In talking to the JAIL4judges founder, Ron Branson and the JAIL4judges attorney about that possibility and some proposed changes to the original Initiative law we discovered that the Special Grand Jury who would review citizen complaints against judges which was being proposed by JAIL was not an appellate review but simply would be the very last remedy available after that person has exhausted all other available legal remedies.

As someone who has been in court 700+ times, I can assure you that is no remedy for someone whose rights are being violated or whose children or property are being stolen etc.,etc.

Please read and understand the proposed J.A.I.L. initiative and understand how it will work in "real time" or in the "real world"

We desperately need judicial reform in this country. A lot of the time it is more important what a judge had for breakfast than the laws or factual circumstances surrounding a litigants case are.

Between 1995 and 1999 there were some 915 complains filed against judges by citizens of this state. These complaints currently are reviewed by the Idaho Judicial Council which is a body of judges,lawyers and a couple others which are handpicked by the governor. (The wolf guarding the henhouse)

Out of that some 915 complaints that were filed - only one formal charge was made by the council.

Judicial Tyranny is the law of the land!
And in this case some remedy may be the equivalent of no remedy.

To naively believe that an organization with a name like "JAIL4judges" will gain the support of the Legislative branch of government is not realistic and to believe that an initiative like the one under consideration will become an amendment to some state's constitution is not in the realm of reality.

The JAIL4judges organization is gaining some momentum and patriots are somewhat rallying to give it their support. All I hope is that you will actually read the proposed initiative and become informed before throwing your time, energy, and money at it.

P.S. I am not just some disgruntled judicial advocate who was fired from his post. In fact, no such scenario has taken place and as far as I know the national organization is still awaiting my official resignation as JIC here in Idaho. As I'm sure this post will get back to the JAIL4judges national office, please consider this as my official resignation.
