SUBJECT: Congress lies. It cannot declare wars anymore.

Dear Mr. Thurmond:

It is time for you to inform your constituents that Congress cannot declare war because of some fancy legislation introduced during President F.D. Roosevelt's administration. Congress has neglected to correct this terrible travesty upon the U.S. Constitution and its citizens.

Here is a quote from Congressman Beck in 1933 prior to the passage of the Farm Bill:
"I think of all the damnable heresies that have ever been suggested in connection with the Constitution, the doctrine of emergency is the worst. It means that when Congress declares an emergency, there is no Constitution . . . for when this bill becomes law, . . . there is no longer any workable Constitution to keep the Congress within the limits of its Constitutional
powers."

According to Senate Report 93-549, once an emergency is declared, there is no Constitution
(written by Congress in 1973):

"Since March the 9th, 1933, the United States has been in a state of declared national
emergency. Under the powers delegated by these statutes, the President may: seize
property; organize and control the means of production; seize commodities; assign
military forces abroad; institute martial law; seize and control all transportation and
communication; regulate the operation of private enterprise; restrict travel; and . . .
control the lives of all American citizens."


For over 69 years Congress has allowed a "state of emergency" to exist without informing the public about its consequences. That is why Congress did not declare war against Korea, Vietnam, and Iraq. It can't.

The U.S. Constitution clearly states that the President does not have the title "Commander in Chief" until Congress declares a war and grants him two years to perform the duty. Article II, Section I states:

"The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States."

The President does not have the Commander-in-Chief title without Congressional approval.
So what has Congress all been doing? Nothing. According to 12 USC, Section 95(b),
everything the President or the Secretary of the Treasury has done since March 4, 1933 is approved automatically! It states:

"The actions, regulations, rules, licenses, orders and proclamations heretofore or hereafter taken, promulgated, made, or issued by the President of the United States or the Secretary of the Treasury since March the 4th, 1933, pursuant to the authority conferred by Subsection (b) of Section 5 of the Act of October 6th, 1917, as amended
[12 USCS Sec. 95a], are herby approved and confirmed. (Mar. 9, 1933, c.1,
Title 1, Sec. 1, 48 Stat.1]."

FDR issued his Proclamation 2038 on March 9, 1933 that is known as the Act of March 9, 1933:

"Be it enacted by the Senate and the House of Representatives of the United States of America in Congress assembled, that the Congress hereby declares that a serious NATIONAL EMERGENCY exists and that it is imperatively necessary speedily to put into effect remedies of uniform national application."

This rule, a Rule of Necessity by which necessity knows no law, was invoked to remove the authority of the Constitution. [Chapter 1, Title 1, Section 48, Statute 1]

Today, this country remains under the Rule of Necessity in a declared state of national
emergency. Congress tied its own hands tied and gagged its own mouth! It has been
pretending to have authority while the President dictates from his Oval Office.

Also, under this Act of March 9, 1933, Section 2, amended the October 6, 1917 legislation entitled, "The Trading with the Enemy Act or War Powers Act", to read, "any person within the United States or any place subject to the jurisdiction thereof."

Therefore, all United States citizens were made enemies to the United States Government via declaration.

The citizens of the United States have no personal Rights at law in any court. All Rights of an enemy (i.e., all American citizens) to sue in the courts are suspended, whereby the
public good must prevail over private gain. This allows for the taking over of enemy private property. This is why we no longer are allowed to receive allodial freehold titles to our land
. . . we are enemies of the government. Our property is no longer ours to have.
Congress did this to us.

Roosevelt also issued Proclamation 2039 and closed down the banking system under the excuse that American were hoarding gold. Then, he issued Proclamation 2040 to declare on March 9, 1933, the creation of a national bank emergency and it states:

" . . . all Proclamations heretofore or hereafter issued by the President pursuant to the
authority conferred by section 5(b) of the Act of October 6, 1917, as amended, are
approved and confirmed."

Again, I repeat, once an emergency is declared, there is not common law and the
Constitution is automatically abolished. We are not under Law. It has been abolished.
We are under the War Powers. Our stocks, bonds, houses, and land can be seized
by the government at any time because we are "enemies of the state." The President
of the United States was made a permanent Commander-in-chief of th military war
machine, which will war against its own citizens if he commands it to do so.
Congress let this happen.

How can this "state of emergency" be ended? The President must proclaim that the
national emergency is over and has ended. Because the Act allows the President to
decide when he wants to return to Constitutional government, the Congress literally
handed the President the powers of a dictator.

For over 60 years, no President has been willing to give up this extraordinary power . . .
ruler of the most powerful military nation on Earth . . . under which Americans are an
enemy subject to tribunal district courts (i.e., Federal courts) under Martial Law wartime
jurisdiction (i.e., guilty until proven innocent); under an unconstitutional Dictatorship.

As an educator, I ask you to announce to the constituents you serve what has happened. They are afraid to believe the truth because it is so terrifying, but they have a right to know the Truth. Our elected leaders must come forward, even at their own peril, and tell the Truth. I ask you to lead them and explain to the American people that Congress cannot declare war. Their President is a dictator.

The lives of our children may depend on your honesty, integrity, and duty to your
country. Freedom is in peril. The U.S. Constitution must be defended.
Please, do not fail us.
