It may be of interest to those of you who lean heavily on the 861 argument of Larken Rose, that you can add another argument to the 861.

If you look in 3401 definitions of "employee" and "employer", you will only find Treasury decisions listed at the end of the definitions in CFR 31.3401. These are the regulations on which the definitions are crucial to knowing as to whom 3402 applies (Withholding). The Treasury Department is not a lawmaking body and can only write rules for government employees. Here is a court ruling on the matter:

“… we sympathize with the taxpayer who in fact relies upon what he accepts as an authoritative interpretation of the laws and of Treasury Publications. But nonetheless it is for Congress and the courts and not the Treasury to declare the law applicable to a given situation.” (Carpenter v. United States 495 F 2d 175 at 184).

Please note that the "United States" and the "United States of America" are separate and distinct entities with differing jurisdictions. Whenever you are acting outside of the United States and its territories in a legal case, you must use the "United States of America" on the affidavit instead of the "United States". The prosecuting attorneys are illegally filing under the "United States of America" because that entity does not fall under the Constitutional provisions and protections of the Constitution. I welcome further comments or corrections.
