Home Intruder Shooting Won't Proceed To Grand Jury

PORTLAND, Ore. -- A Portland man who shot a burglary suspect in the head will not be charged with a crime, according to the district attorney's office.

Police said Leroy Hudson, 71, shot 26-year-old Brent Sweet in the head as Sweet allegedly tried to break into Hudson's home on Northeast Glisan Street last month.

During the break-in, Hudson's wife called 911 to report the break-in. As she was speaking with the dispatcher, her husband fired his gun, according to police. Sweet survived the gunshot. He is out of the hospital and appeared in court Monday.

On Monday, the Multnomah County District Attorney's Office ruled the shooting will not proceed to a Grand Jury.

Sweet has been charged with one count of criminal trespassing in connection with the incident.
