My name is Eric Powers and I am a freelance writer living in Arkansas. I've recently been alerted to a case here in Arkansas that I think deserves a bit of attention.
The entire ordeal is reminiscent of Randy Weavers situation (except these folks aren't white separatists).
I can give you a lot more detailed information on the case as well as Dash Cam footage from the arresting officers car, but essentially here are the key points.
Robert and Melanie Johnston were headed home to Missouri on Jan 3rd, 2004 when they got stopped near Harrison Arkansas by an officer Jason Brisco. they were stopped for driving 6 miles over the speed limit.
Neither have a criminal record, and all of their paperwork was in order. When the officer returned to the car he is seen putting on his gloves as he approaches and asks Robert to get out. When Robert asks the officer why, the officer responds that he either get out or he (the officer) will pull him out. When Robert asks again why, the officer punches Robert twice in the face. Robert decides to remove his family from the potentially dangerous situation and the officer breaks his window with a night stick as Robert is Fleeing the scene.
After a chase by local authorities the Johnstons vehicle is shot 3 times by law enforcement officials (deny firing on the vehicle) and disabled (The Johnstons have the bullet from the front tire, but not from the back of their SUV). On the Dash Cam footage numerous times you can hear the officers being advised there are children in the vehicle.
After requesting and being denied a change of venue 10 months later a drug charge is added to the existing charges for a white powder residue found in a film container in the glove box. Melanie Johnston claims it is from Childrens Motrin, yet the prosecution has not had the substance tested.
14 months later they receive less than 24 hours notice of their trial date and have to leave for the courthouse. On the way to the courthouse they are phoned by their attorney who tells them they need to get out of their vehicle with their hands up when they arrive because the courthouse is in 'Lock Down' and over 100 armed officers including a SWAT team are awaiting their arrival at the courthouse. They fail to appear out of fear for their lives. The list of charges against them is staggering, and no TV stations, Radio Stations or News Papers are reporting the story, except for the Local Paper which has run 3 stories with false information made to shed a positive light on the actions of the Police Department.
This situation is totally out of control and they are now being held without bail in Harrison pending a trial date some time near the end of summer. They are not allowed phone calls or visitors, and Self Addressed Stamped Envelopes sent to them through U.S. mail are being withheld from them so correspondence is nearly impossible. Even as I write this I am trying to get more information on this to write a complete Chronology of Events complete with Police Reports, interrogation transcripts etc. A relative of the Johnstons is sending me a packet with much more information that I hope to receive in the next few days. A copy of the Dash Cam footage is also available.
