I was too hasty in my suspicions, which proved to be unjust, and false accusation of "imposter" was levelled on a very zealous Constitutional group, who desire to assert the Constitutional right to bear arms, in peaceful protest, as has been done a few other times historically. APFN has rightly deleted my post as well. (My fear was that a provocation was being staged by an "plant"). I have contacted the author, and his post on the "Sons of Indiana" movement is spelled out below, and worthy of all due consideration.

It is NOT unlawful, constitutionally, to bear arms, and the anti-Constitutional government HAS threatened thru new laws, and direct violence against its own citizens, and USA PATRIOT Act legislation, every American's liberties, which they may apply at anytime, without warrant, on mere suspicion. A peaceful armed protest could reassert those consitutional liberties (and by many "conservatives"), and demonstrate that Americans will NOT give up those liberties, or tolerate abuse or tyranny, in the guise of "peace and safety". Is it not our Constitutional right to do so?

I apologize for my impugning of a just cause, retract my false charge of "imposter" (entirely untrue), and call on others to reconsider the author's proposal in their own conscience, considering the very present danger hovering over all of us now, and seeking to expand itself, under the guise of "war on terrorism" and "Homeland Security".

state of preparedness for a number of situations that may arise. These
situations include, but are not limited to: invasion by a foreign power,
invasion by foreign soldiers under multinational command, suspension of
Constitutional rule, natural and man-made disasters, support of
Constitutionally legitimate State and Local Government agencies, search
and rescue situations, and any other number of emergencies.

MANUAL FOR THE SONS-OF-INDIANA (S.I.) MILITIA CORPS

2004

MILITIA:

An unorganized, well-regulated, and independent citizen militia.

PURPOSE:

To establish the historical and Constitutional precedent for the establishment of the SONS-OF-INDIANA Militia Corps S.I.. To explain its mission and goals and to explain the organizational structure of the S.I..

"A well regulated militia being necessary to the security of a free State, the right of the people to keep and bear arms shall not be infringed." [Amendment 2 of the united States Bill of Rights.]

"Every person has a right to keep and bear arms for the defense of himself and the State". (S.I.)

BACKGROUND:

There has been many debates over what the militia is and who controls it. Some believe it is the National Guard, while others state that it is only part of the Guard. Much of the debate is focused on the individual citizens right to keep and bear arms. What the second Amendment means; and why it specifically added as an inalienable right.

During colonial days the militia was more-or-less loosely controlled by colonies, generally formed for common defense around geographical limitations, and comprised of all able-bodied men between the ages of seventeen and forty-five. All were required to have their own musket, ball, powder, flint and knapsack. In1792, the 2nd Congress passed a statute establishing "An uniform militia throughout the united States." It detailed every able-bodied male citizen between the ages of eighteen and forty-five be enrolled therein and to equip him with appropriate weaponry. However, this statute was repealed in 1901 when Theodore Roosevelt declared, "Our militia law is obsolete and worthless." The reason for this was that it was poorly equipped and trained. Simply stated, not enough had been done to organize a nation-wide militia.

In 1903 the Dick Act was passed by Congress. This act divided the class of able-bodied male citizens between the ages of eighteen and forty-five into an "organized militia" to be know as the National Guard of the several states, and the remainder to be described as the Reserve Militia which later statutes have defined as the "unorganized militia."

Congress then decided to federalize the National Guard. The National Defense Act of June 3, 1916, 39 Statue 166, provided in part: "That the Army of the United States shall consist of the Regular Army, the Volunteer Army, the Officers’ Reserve Corps., the National Guard while in the service of the United States, and such other land forces as are now or may hereafter be authorized by law." Notice that Congress included all elements of both "organized" and "unorganized" militia into the federal National Guard.

Therefore, if Congress has expressly established the identity of the organized militia, what then is the unorganized militia of the united States?

United States Code, Title 10, Section 311, page 95, defines militia:

(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are commissioned officers of the National Guard.

(b) The classes of the militia are:

(1) the organized militia, which consists of the National Guard and the Naval militia; and

(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval militia.

Section 312. Militia duty exemptions:

(a) The following persons are exempt from militia duty:

(1) The Vice President.

(2) The Judicial and Executive officers of the United States, the several States and Territories, Puerto Rico, and the Canal Zone.

(3) Members of the armed forces, except members who are not on active duty.

(4) Customhouse clerks.

(5) Persons employed by the United States in the transmission of mail.

(6) Workers employed in armories, arsenals, and naval shipyards of the United States.

(7) Pilots on navigable waters.

(8) Mariners in the sea service of a citizen of, or a merchant in, the United States.

(b) A person who claims exemption because of religious belief is exempt from militia duty in a combatant capacity, if the conscientious holding of that belief is established under such regulations as the President may prescribe. However, such a person is not exempt from militia duty that the President determines to be noncombatant.

Has the definition changed?

If it has, and the Federal Government has denied the citizens the right to be part of an unorganized civilian militia, then we are in grave danger in our country. Congress has never repealed the National Defense Act, which made the National guard and its reserve forces part of the Federal Army. The question then is this: "Where is the unorganized militia today?"

It is our understanding that SONS-OF-INDIANA Militia Corps S.I. constitutes and fulfills the roll of the unorganized militia.

Can it be debated that the militia is the National Guard if the National guard is not independent of the organized government? Can it be contested that the organized militia at all levels belong to the government? Since this is true, there exists no standing force able to keep the State’s forces at bay should they desire to move against the citizens. Do we believe Paul Revere’s militia unit was part of the organized government of his time? We think not. It was clear to the early patriots that the militia was independent of the organized government and made up of the people who stood ready to repel a tyrannical government from denying the rights of liberty under the Constitution. It is equally clear to the members of the S.I. today. Furthermore the founders or our government believed that power should remain in the hands of the people to stop the usurpation of power by government. For this expressed reason they believed in the militia-system where all citizens should ! keep and bear arms.

Like it or not, the only reason a civilian, or "unorganized" militia exists, is to keep government in check so that government may remain in the hands of the people. Patrick Henry, the principle supporter of the Bill of Rights, set forth this resolve at the second Virginia Convention, March 23, 1775, when he said:

"Resolved, that a well-regulated militia, composed of gentlemen and yeomen, is the natural strength and only security of a free government; that such a militia in this colony would for ever render it unnecessary for the mother-country to keep among us, for the purpose of our defense, any standing army of mercenary soldiers, always subversive of the quite, and dangerous liberties of the people and would obviate the pretext of taxing us for their support.

That the establishment of such militia is, at this time, peculiarly necessary, by the State of our laws, for the protection and defense of the country, some of which are already expired, and others will shortly be so; and that the known remissness of Government in calling us together in legislative capacity, renders it too insecure in this time of danger and distress, to rely that opportunity will be given of renewing them, in general assembly, or making any provision to secure our inestimable rights and liberties from those further violations with which they are threatened.

Resolved, therefore, That this colony be immediately put into a state of defense, and that there be a committee to prepare a plan for embodying, arming, and disciplining such a number of men, as may be sufficient for that purpose."

The precedent for the SONS-OFINDIANA Militia Corps S.I. has been set by others, generations ago. Therefore, it is to us, the inheritors of the task begun more than two centuries ago, to seek and secure these same ideals in the face of the same threats expressed by Patrick Henry. To wit, that the organized government, having removed itself from the citizens, inter-se, had intended to dissolve the rights and liberties of free people. To that end, the mission of the SONS-OF-INDIANA Militia Corps S.I. is hereby set forth.

MISSION:

To defend the Constitution for INDIANA the State and the Constitution for these united States of America. To uphold and to defend the Bill of Rights, seen as unalienable, given by God to free men that they remain free. To insure that all citizens regardless of race, color, religion, sex, physical characteristics, or national origin; shall have the right and opportunity to due process of law as established and guaranteed by the Great Documents which guide this great nation.

GOALS:

It shall be the goal of the SONS-OF-INDIANA Militia Corps S.I. to:

1) Present itself to the citizens of this region as a well-regulated, well-trained, well-equipped, and knowledgeable militia unit, comprised of ordinary citizens rather than professional soldiers.

2) Establish a cohesive command structure able to instruct and to task as need arises.

3) Train its members in the many disciplines necessary to the function of the militia as a whole, and as members individually.

4) Educate its members in areas of history, law, and principle, though knowledge imparted by this country’s historical record; and from the Bible, which has been the greatest single guiding influence for all great nations desiring to be free.

5) Inform its members of local, national, and global events imperiling the Constitution, and impacting the direction of the country.

6) Encourage its members to stand against tyranny, globalism, moral relativism, humanism, and the New World Order threatening to undermine our form of government, and these united States of America.

7) Uphold the pure constitutional rule of law whereby all citizens have the right to trial by jury of their peers in a court of law.

8) Seek the protection, wisdom, and leadership of Almighty God as we submit to Him to do His will in protecting the liberty and freedom which He has given to all.

ORGANIZATIONAL STRUCTURE:

In order to achieve those goals, a command structure made up of a Commander and Command Staff be created. Subordinate to Command Staff shall be support elements. Each element to consist of subordinate units necessary to carry out the mission of the brigade(s). The organization shall be structured as follows:

* COMMANDER
* CHAPLAIN
* INTELLIGENCE
* INFORMATION
* SECURITY
* OPERATIONS
* TRANSPORT
* SUPPLY
* COMM / ELECT
* TRAINING
* MEDICAL
* AIR OPS
* GROUND OPS

SPECIAL OPS / SAFETY

The Command structure shall be made up of commissioned officers. The commander shall hold rank of major. Staff unit officers shall hold rank of captain. Subordinate staff unit officers shall hold rank of lieutenant. Squad leaders (if not the officer in charge) shall be assigned the rank of sergeant. Squad members shall be assigned the rank of corporal and private based upon experience.

The basic weapon of the brigade member shall be the rifle. It shall be required of all militia members who are not otherwise opposed for conscience sake to have his or her own rifle, ammunition, and knapsack. Militia members are required to maintain proficiency in the maintenance and safe operation of the rifle and to have a minimum of one hundred rounds of ammunition available at all times. The knapsack, thus outfitted, will be kept available at all times for rapid employment by the militia member.

Only when ordered, shall members of the brigade carry concealed firearms during brigade operations.

Militia members are normally expected to carry military style firearms when attending militia duties. Only in self defense shall a militia member discharge his or her rifle except when order to do so. As with members of the organized military units within INDIANA, militia members are expected to abide by all hunting rules and regulations pertaining to the use of appropriate firearms for that purpose.

All militia members will be required to take an oath contained in this manual, to uphold the Constitution for these united States and to protect it from all enemies.

While it is intended that militia intrude as little as possible in the private lives of its members, it is also clear that individual members are volunteers and must be re
