Dear Congressman Tom Tancredo,
Since we now live in a country of pick and choose laws I was wondering if
Congressman Tancredo could assist me in my choice. President Bush has chosen
to ignore our laws and his oath of office, particularly that pesky little part
about defending borders, but who needs that nonsense. I hereby choose to
withdraw my unconstitutional obligation to pay into the IRS tax system. If
Congressman Tancredo could assist me I would love to have this paperwork done
before the April deadline.

Harmful Anti-Immigrant Provisions in H.R. 418
Sections 101, 103 and 104—Unfair Barriers to Asylum Protection
Section 101 would impose unfair barriers to refugee protection. For example,
asylum seekers would have to prove that a “central reason” their persecutors
have for harming them is because of their race, nationality religion,
political opinion or membership in a particular social group, e.g., a union or
student group. A child seeking asylum, who would have a hard time
understanding or meeting such a requirement, could be denied asylum. Asylum
seekers whose persecutors have mixed motives could be denied, e.g., a woman
raped by a government soldier who acts both out of personal hatred for her and
to carry out his army’s campaign of ethnic cleansing.
Section 101 would also require asylum seekers to supply corroborative evidence
about what they suffered, something particularly difficult for children or for
anyone isolated in immigration detention where 80 percent are not represented.
Asylum seekers could be denied asylum based on inconsistencies in what they
tell different officials, their demeanor as they speak or the extent to which
the Department of State Country Reports corroborate their persecution. Mental
health professionals who work with victims of torture insist that demeanor
simply is not an accurate judge of a torture victim’s credibility. These
provisions would likely hurt the most vulnerable. For example, a woman who
fled rape by a uniformed soldier in her country might show visible discomfort
in the presence of a uniformed DHS border guard, which would make her
vulnerable to denial. Her post-traumatic stress could easily give her an
evasive demeanor and emotionless presentation as she related her trauma. If
she was persecuted in a remote part of her country, if the country is
especially repressive or if political persecution is recent, documentation of
persecution will be extremely difficult to attain. The bill would virtually
eliminate federal court review of denial of asylum based on lack of
corroborative evidence.
Sections 103 and 104 allow victims of terrorist or militant groups to be
deported or barred from receiving asylum based on overly broad definitions of
what constitutes engaging in terrorism. Some people who come to the United
States seeking asylum are doing so because they were forced at gunpoint to pay
money to a terrorist organization or may have given money to a school or
hospital without knowing the ties to a terrorist organization. Under the REAL
ID Act, these innocent people would be barred from asylum for the same reason
they are seeking it.
Take, for example, the plight of Colombians who have been forced to make
payments to groups like the United Self-Defense Forces of Colombia (AUC), the
Revolutionary Armed Forces of Colombia (FARC) and the National Liberation Army
(ELN), all of which are on the U.S. terrorist organization list. These groups
pervade nearly all aspects of Colombian life, and payments to these groups
under severe duress, which often include threats of harm, torture or death to
oneself or a loved one, are a survival mechanism for most Colombians. The
Colombian government is unable to control these groups in many regions of
Colombia and thus, Colombian citizens are too often at their mercy. The United
Nations estimates that at least 70 percent of Colombian refugees referred to
the United States for resettlement had been forced by the FARC or other
similar entity to pay “taxes” or other type of coerced payment, including a
ransom for a kidnapped loved one. Under current law, someone in this situation
could be barred. Under the REAL ID Act, not only would they be barred with no
consideration as to whether their acts actually supported terrorist activity,
but their children and spouse would also be barred from receiving asylum and
could be deported for the involuntary acts of a family member.
Sections 202–206—Unfair Driver’s License Provisions
Sections 202 through 206 would establish extensive federal control over state
issuance of driver’s licenses and state identification cards. If someone is
undocumented or has overstayed a visa, the person could not get a license or
identification card under this system. It would undermine the states’ efforts
to create a driver’s license system that assures that all drivers are
certified to drive, are insured and are carrying valid licenses. This would
drive undocumented people further into the shadows and undermine rather than
improve security.
