WHEREAS Chapter 1 of Title 4 of the United States Code has designedly set forth the legitimate details and specifications of the flag representative of the peace loving people of the United States, which is not the official gold-fringed standard of the United States Army;

WHEREAS the exercising authority of the people of the several united states reside in republican forms of governments within their own Nation-states and not under a dictatorial rule established under the banner of war or fringe of an altered state of agreement;

WHEREAS Chapter 1, Section 8 of Title 4 of the United States Code, which is denominated “Respect for Flag”, initiates with the sentence especially proclaiming that “No disrespect should be shown to the flag of the United States of America; the flag should not be dipped to any person or thing.”; and moreover, Chapter 1, Section 8(g) of Title 4 of the United States Code specially disavows the addition of gold fringe or the like to the flag of the United States through the revealing particulars of “The flag should never have placed upon it, nor on any part of it, nor attached to it any mark, insignia, letter, word, figure, design, picture, or drawing of any nature.”; and what is more, Chapter 1, Section 8(j) of Title 4 of the United States Code specially forswears any inappropriate alteration to the flag of the United States through the particular revelatory declaration that “ . . . The flag represents a living country and is itself considered a living thing. . . .”;

WHEREFORE the gold-fringed standard must be replaced by the constitutional flags of this grand Nation-state and of this great national-Union, and everafter have placement of no other, unless and excepting in a legitimately DECLARED state of Martial Law or a lawfully PROCLAIMED National Emergency, and any and all publicly employed servants must show proper respect for the above-styled Demand.

Unless permitted to fly the battle flag, the hoisting of the gold-fringed standard may be a violation of the Flag Protection Act of 1989 [103 Stat. 777, October 28th, 1989] in that a Title IV flag has no fringe and may be considered defaced if there is an addition of fringe, setting up the perpetrator under Title 18, Part I, Chapter 33, Section 700(a) of the United States Code.

The Articles of War, which was adopted by the United States Congress in 1806, was the predecessor of the Uniform Code of Military Justice; these Articles equally governed the armies of both the Union and the Confederacy. Article 33 of these military regulations clearly identify members of the Judicial Branch as Officers of Justice rather than Officers of the Court, when mandating “. . . use their utmost endeavors to deliver over such accused person or persons to the civil magistrate, and likewise to the aiding and assisting to the officers of justice in apprehending or securing the person or persons so accused, in order to bring him or them to trial. If any commanding officer or officers shall willfully neglect, or shall refuse, upon the application aforesaid, to deliver over such accused person or persons to the civil magistrate, or to be aiding and assisting to the officers of justice in apprehending such person or persons, the officer or officers so offending shall be cashiered.”. Moreover, justice and fair play must be delivered under the law but have been known to be sacrificed under a distressed military standard.

Article II, Section 2, Clause 1 of the Federal Constitution dictates that “The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States;” however, Article II, Section 1, Clause 8 of the Federal Constitution makes the higher demand that “Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation: -- “I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.””. The preservation, protection, and defense of the Constitution can not be had if the activity of such Office is without end under a flag inassimilable to the very nature of the Oath.

The foundation of this great nation is not built upon the premise of war with the flying of her flag of combat, the gold-fringed standard, but upon the peace of the many peoples of this land, through the Preamble which unwaveringly has decreed “We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”.

The Constitution for these united States is the supreme law of the land, and provisions of the Constitution for the State of Florida have reinforced the federal protections of this charter document; The proclamation of the Supremacy Clause of Article VI, Clause 2 of the Federal Constitution contributes the highest law of the land, which is inviolate and indefeasible, to be “This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”.

Therefore, it is an absolute that, in this instance, in the Federal Constitution’s Article IV, Section 4 intrinsically guaranteed “Republican Form of Government”, the Delegation Doctrine would not comprehend the gold-fringed standard substitute for the official Title IV flag. The United States is A Republic If You Can Keep It, wherein [in the words of United States Supreme Court Chief Justice Earl Warren, at page 61] “In the United States the people are sovereign. The powers of the government are only those delegated to it by the people.”.
