ARMY AGENT TESTIFIES AT DROWNING TRIAL

U.S. soldiers ordered two Iraqi men into the Tigris River merely to teach them "a lesson" for violating curfew, a witness testified at a court-martial. Only one of the two Iraqi civilians got out alive, authorities said Tuesday as the military trial got under way for Army Sgt. 1st Class Tracy Perkins. He is charged with involuntary manslaughter, conspiracy, aggravated assault, obstruction of justice and lying to investigators.

JUDGE DISMISSES KENNEDY SMITH CIVIL SUIT

An attorney for William Kennedy Smith said he hopes his client will resume his medical career now that a judge has dismissed a civil lawsuit alleging Smith sexually assaulted his former personal assistant. Smith, the nephew of Sen. Edward Kennedy, resigned from the Chicago-based Center for International Rehabilitation after the lawsuit was filed. The center helps victims of land mines.

OKLA. JUSTICE ALLEGES AGE DISCRIMINATION

A member of Oklahoma's highest court got passed over for chief justice, and now he's suing his eight colleagues because he thinks they skipped him because of his age. He's 83. State Supreme Court Justice Marian P. Opala filed a lawsuit last week in federal district court, charging he was discriminated against when his fellow justices changed a rule to allow the chief justice to serve consecutive terms. The post had been rotated every two years.

Columbia law professor Michael Dorf contrasts the positions taken in a key, highly controversial Office of Legal Counsel memo on torture dated August 2002, with a new, December 2004 memo on the same subject by the same office. Dorf finds the new memorandum to be generally fair, professional, and in line with OLC traditions, but notes one topic on which the new memo falls short: It does not repudiate the old memo's claim that Congress lacks the power to prohibit torture undertaken at the behest of the President, acting in his capacity as Commander in Chief.

ELIZABETH SMART'S FATHER WANTS PLEA DEAL

The father of Elizabeth Smart says the family wants a quick resolution to the kidnapping and sexual assault charges against the girl's alleged abductor, Brian David Mitchell - even if that means a plea deal. Salt Lake City radio station KSL first reported Ed Smart's comments in a story on its Web site. Reached later at his home by The Associated Press, Smart expressed doubt that anything could be gained by Mitchell's upcoming trial.

Cut the Cheese
JAILED MAN SENTENCED FOR CHEESE SANDIWCHES
Associated Press

A man serving a life sentence for murder was sentenced to three additional years in prison for passing out cheese sandwiches while in jail. Douglas Eugene Wilson, 45, pleaded guilty Monday to possession of contraband and was sentenced by District Judge Thomas Kane. Prosecutors said Wilson had the sandwiches while in jail awaiting trial on the murder charge and he tried to give them to other inmates, which is a violation of jail rules.
