The Kellenberger Legacy.
I've been reporting for a long time that our property rights, which is one
of the cornerstones of liberty, are being taken away. But, few Americans are
even now aware of it until they are smacked in the face by some government
agency.
In the first of these two articles, Tennessee is waking up. But the
statement by State Legislator Williams that this could be
repealed is a bold faced lie. Once it is in place and funded, it will not be
repealed.
The second article details one family's fight against government agencies
to take their land.

This is a copy of the letter I sent to my county commissioner re the PC1101
growth plan....being implemented in every county in TN .........
From: DKurtz@webtv.net (Daniel & Sue Kurtz)
Subject: Growth Plans for Grainger County
Dear Mickey:
I am writing concerning the illegal mandated bill passed in the TN
Legislature in 1998. The bill is called PC110l Senate bill S3278. I called
your office a few weeks ago to acquire a copy of the planned growth map for
Grainger County. I called again today, your secretary advised me the map was
too large to copy. She advised the planned growth had been approved and the
plan was being pursued. I was not aware of such proposals for our county nor
how they originated nor, did I realize the detrimental effects they would
have on our rights to use and own land until I began investigating the plan.
I have objections to this "growth plan". I have expressed this to Mr.
Williams, our State Legislator. He assured me this was a plan , which could
be repealed should it not be to the benefit of the citizens of this county.
He said we had two years to take a look at how it worked.
I see many funds flowing into our county; such as block grants, for sewer,
and water lines , education, HUD grants for housing police department grants
for federal policing . and many "environmental projects" for "sustainable
development".
These funds are delivered to us by the promoters of Regional Government!
This plan is being done illegally......I have sent you documents to this
effect.....
The "sustainable development" idea was delivered to the United States by
the communist United Nations as a way to take control of the citizens rights
and seize land worldwide by passing "sustainable living and environmental
laws"....I have absolute proof of this........
Agenda 21 is the document from where such treaties have been implemented
nation and worldwide for GLOBAL GOVERNMENT!
President Clinton passed an Executive Order forming the President Council
of Sustainable Development in 1995. he appointed federal agencies and funds
to these organizations to implement this dictatorial form of government.
Therefore the hands of the control goes to these non-elected officials.
Since then Agenda 21, United Nations laws are being implemented in every
county of our Nation.
This should be repealed by the State Legislators...I am requesting this
plan be denounced and the funding sent back to the Department of Criminals
to do what they choose....The plan is illegal and unconstitutional...The
Senators participating should be recalled immediately......
Property Rights are being abolished by this illegal act.....More and more
land restrictions are required each time funds are accepted and used by the
local government....Not only that but every elected official in this county
who accepts funding lessens his leadership of this county and subjects
himself to the dictates of the United Nations and the Feds.
For example under the UAB growth plan one who is annexed unwilling is not
subject to a trial by jury! What kind of society do we live in to suggest
such as that........ I thought we lived in America!
Furthermore, if I own a farm I do not want the UN or the Federal government
dictating how I am to use that land! This is happening nationwide where the
towns go ahead and implement these federal programs.......I say NO to this
plan! I was not aware that the meetings had occurred and, actually knew
nothing of the whole matter, until I began investigating Regionalism and
Agenda 21......It links back to local PC1101!
I am requesting a copy of the final plan and a transcript of these four
meetings the public participated in. After reviewing these plans I will make
an appointment with you to view the map.
Many Tennessee County Commissioners and residents rejected these plans and
have filed suit. I continue to say "nothing is free"......We will pay
through enormous tax increases and many stiff environmental
regulations.....I have an informative website with documented proof of these
facts.........
Hopefully, it isn't too late ! There is a concerted effort nationwide to
halt these "growth plans'.......If you have any doubt or questions,
concerning the source of the information my website, http:noregions.org has
all documents there to absolutely prove the "Growth Plan" is a part of the
"land grab" by the Federal Government and the United Nations....

Many thanks, Julie Kay Smithson, The Kellenberger Legacy To Ohio, Good
Neighbors to the Hopewell Mounds,"I?ÇÖve never wanted to live anywhere else.
As far can be seen from my home, the view is pleasing to the eye and a balm
to the spirit. This is my home, and my family has cherished and been the
best of stewards to our land." Looking out from the front porch of Tom and
Nancy Kellenberger home, it is clear why he feels such kinship and pride in
his farm. An hour south of Columbus, the Kellenberger Farm lies just
southeast of Chillicothe. One of its neighbors is the Hopewell Mound Group,
one of several ancient Indian earthworks found in Ohio. The view is
unfettered by development, the wildlife coexists well with the human
residents, and the earth has been coaxed to share her bounty. Corn stubble
exudes its own beauty, and provides nourishment and shelter for songbirds,
waterfowl, and other avian residents and visitors; and a smorgasbord for the
whitetail deer. Level to slightly rolling, the foothills of the Appalachians
as a backdrop, its easy to see why the Kellenbergers chose this place to
sink their roots. Four generations deep, the attachment for the farm is much
more than material or monetary. The responsibility felt for the flora and
fauna is not that of a mercenary, to merely deplete the resources and move
on. Rather, the Kellenbergers have fought, and are fighting, to keep this
place pristine for succeeding generations of Kellenbergers. The human
influence on this land has been an enhancement and not a detriment, as the
fine soil attests, and the mature trees that line the fields testify. The
National Park Service and the Archaeological Conservancy are united with
multiple partners to separate Tom and his family from sixty-four acres of
his 352-acre corn and soybean farm, including both his home and his parents
home.
There has never been a study done on the 64 acres to prove the existence of
an earthworks, and no evidence can be found of such. Certainly, there are
the occasional broken pieces of stone and flint, which exist in numerous
other riverside locations in the Midwest.
It should be noted that while preserving the culture of Native Americans is
admirable and necessary, it has already been done in many places in Ohio,
and the need to take prime production agricultural land for another place
with no ingress by the public, is questionable.
The Kellenbergers have been used by both groups, who made false statements
stating that the Kellenbergers were going to donate the land in question,
untruths that led to the sale of neighboring land. Over the course of nine
years, Tom and Nancy have sought legal assistance, and the intervention of
local groups. Nothing seems to have deterred the NPS and the Archaeological
Conservancy from their chosen course, to disenfranchise the Kellenbergers
from an integral part of their home and farm. The 64 acres is not only "loss
of (farm) income, but also the loss of TWO family homes and the loss of a
part of our lives," as Tom puts it so well.
The essence of this issue is not the preserving for research of this land,
but the removal of private property rights by a federal agency and its
cohorts. The current administration has, in the past eight years, locked up
and removed from public use, more land than in all other administrations,
put together. This is not land that a family can visit and hike, birdwatch,
horseback ride, or camp on. This is not land that can keep our country free
from dependence on foreign oil supplies and imported products, not any more.
Our own government has stolen our country's heritage, and is doing
everything possible in these last days, to make her subservient to a foreign
power, the United Nations. This juggernaut of the taking of privately-owned
land, the USE of privately-owned land, and the public's ability to use
public lands and waters, is WRONG. The Kellenbergers stand as one Ohio
example of what is happening in virtually every state in America: the siege
of the American citizen, the removal of the middle class and the backward
journey into feudalism that our country was founded to thwart!
By telling their story, and many others like it, the author hopes to light
a fire of curiosity and public outrage that bridges the gap between, "...as
long as its not in MY backyard..." and "...its all around me, and I'd better
wake up and get involved!" To expect "someone else" to attend the meetings
and write the letters to the editor and make the phone calls and keep tabs
on the elected officials, is to know what its like to have it done "someone
else's way." If freedom is vital for ones happiness, than one must be
willing to stand up for it! The issue is no longer "if" but "when." Please
