DECLARATION OF TOM MILLER
..............................................................................................................................................I, Tom Miller, state as follows:
1) I am a U.S. citizen over the age of twenty-one and am competent to make this declaration.
2) I am an employee of the United States Government and at all times referred to in this declaration, from 1969 to present, I worked for the U.S. Department of Defense or U.S. department of transportation.
3) I first met Gary Eitel in 1969 and we have remained in contact through out the years , to present. I have worked with Gary Eitel on numerous aviation assignments and I know his work to be professional and truthful in all things.
In April-May 1989, Gary Eitel was employed by Evergreen Airlines as a DC-9 and 727 pilot. Before during and after his employment with Evergreen, he and I had numerous conversations concerning Evergreen doing work as a covert CIA operator. The substance of the conversations was Mr. Eitels concerns that Evergreen and other government agencies were doing things that were illegal.
5) For his employment in Evergreen in April-May 1989, Gary Eitel used me as a personal reference. I responded to Evergreen inquiry concerning Mr. Eitel with favorable comments, specifically, his professional qualifications and his integrity.
6) I have personal knowledge that Gary Eitel was recruited by the CIA in 1976 to fly in Angola.
7) I have personal knowledge that Gary Eitel and his CIA recruiter flew a mission in 1976 involving Evergreen
8) I had no reservations recommending Gary Eitel for employment with Evergreen.
9) As a result of Mr. Eitel's April-May 1989 employment through the Summer of 1989. The substance of those conversations made ton me by Gary Eitel was:
A) Evergreen was operating C-130's out of the CIA's Marana, AZ airbase under disguise of a U.S. Forest Service contract while performing CIA missions.
B) Evergreen was operating a Boeing 727 jet out of the CIA's Marana airbase under disguise of a U.S Postal Service contract while performing CIA missions.
C) Evergreen was operating the same Boeing 727 jet out of the CIA's Marana, AZ airbase under disguise of a Forest Service contract while performing CIA missions.
D) Mr. Eitle further stated the 727 aircraft disguised as as a Postal Service and Forest Service aircraft was equipped with electronic gear for use in intelligence work and was not even equipped as a Postal Service or Forest Service aircraft.
E) Mr. Eitel further stated that Evergreen was underpaying their pilots, even though adequate compensation was provided for by the government.
10) In March of 1989, Mr. Eitel informed me that an Evergreen pilot had been recently murdered because he was using covert information obtained while flying for Evergreen on questionable CIA missions to advance a labor dispute. Mr. Eitel and I agreed working for Evergreen was a very dangerous proposition. (Editor's note: This pilot was murdered using the kind of bottle commonly found on mountain bikes --- with the plastic straw --- to inject Clorex bleach into the stomach of the pilot. "Termination with extreme prejudice" from the CIA often involves extreme agony!!! Is it obvious why so few talk?)
11) Evergreen's work as a CIA or defense contractor falls within the the view of the U.S. government agencies I have worked for. Through Mr. Eitel's efforts, I have provided information to the Defense Department to further their investigation of fraud in defense contracts. Mr. Eitel has been a credible and valuable source of information throughout the years I have worked and known him.
