I was a research scientist at Los Alamos National Lab. for ten years. I worked in the plutonium facility at TA-55. I had the appropriate security clearances. I just got out of a federal prison and after serving 9 months I have won my appeal filed in the US District Court in Fresno CA. I will have a new hearing. The story is complex and I would like to talk with someone. I have court records etc..

On March 29th, 2004 I had just returned to my apartment from spending most of the day in preop preparing for surgery on my left arm the following morning. While I was going between the different places and various tests I was also having a cell phone conversation with my ex-fiancé. Because of my disability (see My Story) I don’t drive and use the city bus for transportation. When I got back to my apartment a Police Officer met me outside of my apartment and placed me under arrest for allegedly stalking and threatening my ex-fiancé.

The Officer informed me “You have that poor woman terrified”, or words to that affect. I was transported from my apartment complex to the county jail. The Officer stopped the vehicle in the drive and removed me from the back seat as around five or six Deputies came out of the building. The deputies began, as the Officer drove off, to haze me and shove me around as they yelled and made jesters at me. I was stunned here I am a disabled 52 year old man with my arm in a cast, high on pain killers and tired after a long day with medical procedures. The County Deputies began a fight and beat me up outside of the jail. They then dragged me into the jail and placed me in a cell in PC. Here the inmate in the adjoining cell began throwing cups of water on me. I returned the favor and was engaged in a water fight that some of the deputies got into using an old class A fire extinguisher to soak me. Needless to say the cast on my left arm didn’t survive all this and that is why my arm looks as it does in the photo on MY DEFENSE page.

Now, I’ll point out the lies and how to tell that my version of what happened on March 29th, 2004 is the truth. The Officer’s version of what happened is contained in MPD 04-32007, see under Police Reports. He claims that I was taken into the sally port and subsequently, while he was booking me, became difficult and had to be forcefully moved to medical. You can be assured the deputies at the jail will support the Officer’s version of that day. But, the records do not. The complaint 1073460 says I was arrested on March 29th, 2004 for 273.6(a) a misdemeanor. The arraignment was done on the 1st of April. In violation of the requirement of the defendant being arraigned within 48 hrs.. So the defendant was never arrested or booked for the charges that the Officer alleges in MPD 04-32007. This is perjury by the Police Officer. This is further documented as being a false Police Report by the Request for Bail Enhancement filed by Police Officer Letsinger. The bail enhancement was filed with MPD 04-49763 which states:

(04-32007) On 3-30-04 William Powell was arrested for stalking and violating a Domestic Violence Restraining Order after contacting Lisa Garofalo in the weeks prior via telephone.

From complaint 1073460 we see that Letsinger has the date of arrest wrong or the complaint does. We also see that Letsinger thinks I was arrested for stalking. Someone is lying and it’s not me. This is a first pass at this and I have more to say and more evidence to show what really happened then. Later the falsified police report from MPD 04-32007 is used to get a Federal Judge to issue a no bail warrant.

Again, I am having difficulties with this section, it still hurts me. I am just going to list some facts for reference later.

On Jan. 26th Lisa called the cops to get me out of her house. But lied to the Officer saying I had hit her. Her word against mine the cop told me she said I hit her in the back of the head. He indicated to me that he didn’t believe it. She didn’t tell him that she had called the cops on Saturday evening. She didn’t tell the cop that I was intoxicated, I wasn’t and the officers that came over Saturday evening will verify this, then as she said in the prelim. The cop said I had a bag packed and I did because I was going to move back to my apartment. The cop says there were no witnesses. Lisa claims I was at the door screaming profanities at her when she was with two neighbors who were out walking etc. It’s all lies and half truths or complete omissions. WHY? Why not tell the whole truth? Why lie? MPD 04-008270.

In MPD 04-23699 She claims and the officer claims to see my number displayed as calls received on her cell phone. My phone records show that my caller ID on both my home phone and my cell phone was blocked. Why lie?

I forgot to mention but filed with MPD 04-39317 is a document entitled EVENTS ASSOCIATED WITH WILLIAM DAN POWELL. This document is dated and can be used to verify almost all her later lies. She lies, the police lie, the DA falsifies records, the deputies beat me up, the Judges dismiss her lies and try to cover things up. And my attorneys let it happen and/or were a party. This all overwhelms me and my disability but I’ll work thru it all and document with records the truth. My fear at this time is that they will discover what I’m doing and devise a way to stop me. Ouch, this hurts.

This is all badly written and I’ll try again. The records and witnesses will show that I wasn’t booked until the 30th. I was never booked for or as Officer Hopkins 10320 claims in his police report MPD 04-32007. Given an opportunity to prepare and present a defense as provided for in the US Constitution I’ll present evidence and testimony as to what really took place that day and how and why the following cover-up ensued.

Here is what happened to me in this matter and the documentation at my website verifies what I’m saying.

As I said above I was beaten and prevented from receiving medical attention for my broken arm. Now I am disfigured. Because I told Lisa I was going to sue over this. She had me arrested again, by lying. Because of all the trouble with the police in this matter I was evicted and had to bail to move. Again, I was set-up and arrested with even more lies.

The two transcripts the one from the preliminary 06-11-04 and the one for probation violation sentencing where the Judge put me in the closet 12-01-04 have been falsified. If one goes thru the documentation included at this website the lies and contradictions become obvious. I have to return to Fresno, CA for re-sentencing on the 21st of October. I am having doubts regarding my safety. I had hoped to have more of the truth about what happened on this website as a defense. But, I have found it more difficult than I expected. Because of this and my fears about going back to court in Fresno I’ve decided to go public with this even though it’s not complete. That is to say that the documentation, police and court records, is fairly complete but I was going to have more pointed out.

This is a quick, hopefully, overview of what happened in this matter.

I crossed wires with some powerful people. First is Lisa with her manipulative abilities and network of power. This is why the Policeman and Deputies did what they did. They tried to cover it up. But, Lisa wasn’t going for it. She came over to talk to me and have sex. I told her I wasn’t going to drop it. That’s why the third arrest. Etc.. Now she’s feeling legally threatened that I can and will expose her. So she lies to get me arrested and bail at $225,000.00. She gets a terrorist threat charge about the phone call to her brother. But, D won’t back her up and she is caught in a lie. They change judges and Whiteside dismisses her lies and the false police report. Later Bessey falsifies the preliminary Transcript. A police Detective imposes as an attorney and goes to a lot of trouble to convince me otherwise. These I catch and they are threatened and must take action in federal court. Get to me thru Lizarraga. Then screw with me in prison. Etc.

I need to write this description of what happened in this matter detailed enough to clearly be understood and at the same time not bog down in the details. Not easy but here goes:

In My Story will be details relating to my relationship with my ex-fiancé Lisa Garofalow. We had broken off our relationship in January of 2004. Our involvement started in Aug. 2003.

This is not easy for me I am disabled. I’ve been beaten, denied medical treatment and unjustly imprisoned.

There are more lies and legal violations in the ensuing cover-up.
