Dear APFN ( http://www.apfn.org/ ):

I'm not sure if we sent you this press release or not.

The oral arguments in former SPC Michael New's case were heard before US Court of Appeals on February 16, where the judges told Attorney Herb Titus, "Your challenge is to convince this court that there are actually Constitutional issues in this case." And then, on 23 May, they dismissed the case, finding that Michael New has received "a fair hearing". This, in spite of the fact that NONE of the evidence proving that the orders involved an unauthorized (and therefore illegal) uniform, an unconstitutional chain of command, on an illegal deployment -- NONE of that evidence has been allowed to be argued in a court of law to this day!

Our press release is attached.

Also, we encourage your readers who have followed the case over the years to go back to our website at www.MikeNew.com , and sign up again for updates. People change e-mail addresses so frequently, and the attrition rate of our address list is very high.

Will we appeal? You can bet on it. Will we win? Don't bet the farm on that! But we will "stay the course", as a mediocre president used to say.

For a Constitutional Republic, once again,

Daniel New

PS. Don't forget that we'll send a FREE copy of the book, MICHAEL NEW -- Mercenary... or American Soldier?, to any active duty personnel, reservists, guards, etc., who request a copy. We even pay the postage. We don't object to some help on this project -- OPERATION BLUE BERET -- but there is no charge for a single copy to a person in uniform, or to a young person contemplating enlistment. We have another generation to educate.

"If ye love wealth better than liberty, the tranquility of servitude better

not your counsel or your arms. Crouch down and lick the hands of those
who feed you. May your chains set lightly upon you. May posterity forget
that ye were our countrymen." - Samuel Adams
