The following is a letter just sent to my two Senators in my state. I
suggest if anyone does not want to see their DMV turned into the Gestapo
booking office for their new papers and electronic/biometric surveillance
leash, that they read it, and consider doing likewise...now! THIS BILL WILL
CHANGE AMERICA IF IT IS PASSED--Giving Michael Chertoff Absolute national
police powers!

Re: Strip REAL ID Act from Iraq war appropriations supplemental
Dear [Recipient Name],
Sir, I write again to urge that you work diligently to ensure that the
conference report on the Iraq war supplemental appropriations bill does not
include the REAL ID Act, which the House attached to their version of the
supplemental bill. The REAL ID Act threatens the rights and liberties of all
American citizens and non-citizens, while doing nothing to enhance safety or
reform our broken immigration system. Please consider my reasons, and note
that there are millions who agree:
The REAL ID Act would give the Secretary of Homeland Security unlimited
powers not subject to judicial review, setting an incredibly dangerous
precedent and conditions for the Secretary to trample our rights. Under the
bill, the Secretary would have authority to waive "all laws" -- including
environmental, civil rights and labor laws -- that he or she determines
would interfere with the construction of barriers and roads along our
nation's borders. These decisions could not be challenged in any court
because the bill exempts such decisions from judicial review.
In addition, the Act would deny asylum to people fleeing persecution in
other countries if they could not meet the unreasonable burden of obtaining
corroborating evidence of their persecution, such as documentation from the
persecuting government. The bill would also give U.S. officials more power
to deny asylum applications based on unproven or irrelevant information, and
would prohibit U.S. courts from reviewing these discretionary judgments.
The Act would also require all "free Americans" to be "pre-booked" as
Criminal Suspects--not free citizens--by giving tyrannical powers to H.S. to
FORCE fingerprinting, facial or iris scans, and even RFID chips in the DLs
at the arbitrary and sole command of Michael Chertoff of Homeland Security,
which would put every "free American" on an electronic and biometric
surveillance leash contrary to Constitutional right to privacy (unreasonable
search and seizure), contrary to 10th Ammendment States Rights, and contrary
to the Constitution of West Virginia (which you have sworn to uphold)--i.e.
"Internal Government and Police" and "Consitutional Continuity of
Government". To treat Americans like criminal suspects by "processing" them
through the DMV is both deceptive and a constitutional outrage, contrary to
due process.
Sir, the REAL ID Act will make America in the exact same mold of Nazi
Germany's Gestapo, or the Soviet KGB, forcing Americans to show their
"papers" to travel "freely", contrary to Constitutional law.
Sir, please consider the following rights to freedom of travel without
hindrance per U.S. Courts:
CASE #1: "The use of the highway for the purpose of travel and
transportation is not a mere privilege, but a common fundamental right of
which the public and individuals cannot rightfully be deprived."
Chicago Motor Coach v. Chicago, 169 NE 221.
CASE #2: "The right of the citizen to travel upon the public highways and to
transport his property thereon, either by carriage or by automobile, is not
a mere privilege which a city may prohibit or permit at will, but a common
law right which he has under the right to life, liberty, and the pursuit of
happiness."
Thompson v. Smith, 154 SE 579.
It could not be stated more directly or conclusively that citizens of the
states have a common law right to travel, without approval or
restriction(license), and that this right is protected under the U.S
Constitution.
CASE #3: "The right to travel is a part of the liberty of which the citizen
cannot be deprived without due process of law under the Fifth Amendment."
Kent v. Dulles, 357 US 116, 125.
CASE #4: "The right to travel is a well-established common right that does
not owe its existence to the federal government. It is recognized by the
courts as a natural right."
Schactman v. Dulles 96 App DC 287, 225 F2d 938, at 941.
This tyrannical anti-constitutional legislation violates our nation's
principle of checks and balances, overthrows State's rights, and betrays our
legitimate asylum-seekers immigrant tradition.
Please make certain that it is not part of the final Iraq war appropriations
bill, which you know is a coercie "package" technique to attempt to force
your hand to bow to "the powers that be". This legislative bully-whipping is
also a red flag that this bill is receiving priority attention and their
desire is to take away your liberty to turn it down. "This administration
has little regard for the Constitution"--does it not? Dishonesty and
downright lies, and coercive legislation, are the hallmarks of Bush
government, which wants to limit judicial review and tyrannize both house of
Congress to bow to its every whim. THIS WAY THIS BILL IS BEING HANDLED AND
PUSHED SHOULD BE A CLEAR SIGN OF THE NEED TO OPPOSE IT.
In short, the REAL ID act does NOT do what it promises, and is similar in
the coercive and secretive forced used to pass the anti-constitutional
Patriot Act. This is not "defending freedom", but erecting tyrany if passed,
and puts ABSOLUTE POWER in the hands of Michael Chertoff--whose allegiance
is to Israeli government by citizenship (a foreign power)--much like
history's worst tyrannical governments. America, would become a Police State
if REAL ID is passed. (Montana has alredy condemned it, with both Republican
and Democratic support).
Sir, I remind you of your constitutional oaths to DEFEND the Constitution of
the U.S. and West Virginia, both of which require you to publicly oppose
this anti-American legislation.
