Former congressman asks court to decide if Bush committed war crimes

LINCOLN -- Former U.S. Rep. Clair Callan of Nebraska has asked a federal court to determine if President Bush is guilty of war crimes in Iraq.

Callan has filed a motion for a temporary restraining order in U.S. District Court in Lincoln that would stop the president from ordering further attacks in Iraq.

Callan argues that Bush is in violation of international law, including United Nations treaties and the findings of the Nuremburg Tribunal, for ordering the invasion of a country that has not attacked the United States.

"Let's say the president decides to invade Iran or Syria next. There's apparently nothing to stop him from doing that," Callan said.

Callan filed the motion Thursday. Federal attorneys have 60 days to respond.

A federal judge last month denied Callan's request for the court to block the president from starting the war in Iraq.

"I couldn't stop this war, so now I want to make sure this country will never do this again," Callan said. "We cannot pre-emptively declared war. This is the first time this has happened and hopefully the last."

Callan, who is from Fairbury, served in the House of Representatives from 1965 to 1967 as a Democrat.
